All services provided by Motion Miles Logistics (“Company”) are expressly subject to availability. While the Company endeavors to meet all customer requirements and expectations, the Company makes no representations or warranties, express or implied, regarding the availability of services or the adherence to specific pickup or delivery timeframes, except where such timeframes have been expressly agreed to in a separate written agreement executed by an authorized representative of the Company.

The Client acknowledges and agrees that various factors beyond the Company’s reasonable control—including, but not limited to, traffic conditions, weather events, acts of God, governmental actions, and other unforeseen circumstances—may affect scheduling and the timely provision of services. Accordingly, the Company expressly reserves the right, at its sole discretion, to modify, delay, reschedule, or refuse service, in whole or in part, as may be necessary to ensure the safety of personnel, compliance with applicable laws and regulations, or for any other operational reasons deemed appropriate by the Company.

Nothing in this Disclaimer shall be construed as creating any guarantee, warranty, or promise of service availability or timing, except as may be expressly set forth in a written agreement signed by both parties.

Motion Miles Logistics makes every effort to ensure the accuracy, reliability, and timeliness of our services. However, all services are provided on an "as-is" and "as-available" basis. By using our services, clients acknowledge and accept that:

• Motion Miles Logistics is not liable for delays caused by weather, traffic, vehicle malfunctions, or other circumstances beyond our control.
• We do not guarantee specific delivery times unless expressly agreed to in writing.
• We reserve the right to cancel or refuse service at our discretion.
• Customers are responsible for providing accurate delivery information. Motion Miles Logistics is not responsible for issues arising from incorrect or incomplete details.
• We are not liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, loss of business, or personal injury, unless due to proven negligence or misconduct.
• Any disputes or claims will be governed by the laws of the state in which the service was provided.
