Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Motion Miles Logistics LLC (“Motion Miles Logistics,” “Company,” “we,” “us,” or “our”). By accessing or using any services provided by Motion Miles Logistics, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our services.

  1. Scope of Services

    Motion Miles Logistics provides local delivery and last-mile logistics solutions, including but not limited to scheduled deliveries, on-demand services, and business-to-business logistics support (collectively, the “Services”). The specific nature and scope of Services to be provided shall be as set forth in the applicable order confirmation, service agreement, or booking.

  2. Bookings and Payments
    • All bookings must be made in advance through our designated website, online platform, or authorized booking system.
    • Full payment of all applicable fees, as specified at the time of booking, is required to confirm and secure the requested Services.
    • The Customer agrees to provide accurate, complete, and current information for all bookings and payments.
    • All fees are non-refundable except as expressly provided in these Terms or as required by law.
  3. Cancellations and Refunds
    • Cancellations must be submitted in accordance with the procedures specified on our website or communicated in writing.
    • Cancellations made less than twenty-four (24) hours prior to the scheduled service time may not be eligible for a refund or 30% of the total delivery costs.
    • In the event of a no-show or failed pickup attributable to the Customer, Motion Miles Logistics reserves the right to charge a service fee or withhold any refund, at its sole discretion56.
  4. Right to Refuse or Cancel Service
    • Motion Miles Logistics reserves the right, at its sole discretion, to refuse, suspend, or cancel any order or Service, in whole or in part, without prior notice, for reasons including but not limited to safety concerns, scheduling conflicts, suspected fraud, violation of these Terms, or non-compliance with applicable laws or regulations.
    • The Company shall not be liable for any loss or damages arising from the exercise of such rights27.
  5. Liability and Damage
    • Motion Miles Logistics shall exercise reasonable care in the handling and transportation of goods. However, the Company shall not be liable for any loss, damage, delay, or failure to perform caused by:
      • Improper or inadequate packaging by the Customer or third parties;
      • Acts of God, force majeure events, weather conditions, or other circumstances beyond the Company’s reasonable control;
      • Acts, omissions, or interference by third parties not under the Company’s direct control567.
    • In no event shall Motion Miles Logistics’ aggregate liability for any claim arising out of or relating to the Services exceed the total amount paid by the Customer for the specific Service in question.
    • The Customer is responsible for ensuring that all shipments comply with applicable shipping, labeling, and packaging requirements56.
  6. Customer Warranties and Obligations
    • The Customer represents and warrants that they are authorized to request the Services and that all information provided is accurate and complete.
    • The Customer agrees to comply with all applicable laws, regulations, and these Terms in connection with the use of the Services.
  7. Indemnification

    The Customer agrees to indemnify, defend, and hold harmless Motion Miles Logistics, its affiliates, employees, agents, and subcontractors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

    • The Customer’s breach of these Terms;
    • The Customer’s violation of any applicable law or regulation;
    • The Customer’s negligence or willful misconduct6.
  8. Modifications to Terms

    Motion Miles Logistics reserves the right to modify, amend, or update these Terms at any time, at its sole discretion. Any changes will be effective immediately upon posting on our website or other official communication channels. Continued use of the Services constitutes acceptance of the revised Terms27.

  9. Governing Law and Dispute Resolution

    These Terms shall be governed by and construed in accordance with the laws of the State in which Motion Miles Logistics is incorporated, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the courts of competent jurisdiction located within such State56.
